Terms of Use for Simple BP Tracker

1. Purpose of Simple BP Tracker

Simple BP Tracker is a simple personal record-keeping tool that allows users to manually record blood pressure readings and generate a report of those readings.

The App may allow you to:

• Record the date and time of a blood pressure reading;
• Record systolic and diastolic blood pressure values;
• Review recently recorded readings;
• Calculate a mathematical 30-day average from retained readings;
• Enter identifying information for inclusion on an exported report; and
• Generate and share a PDF containing retained blood pressure information.

Simple BP Tracker is intentionally limited in scope.

2. Simple BP Tracker Does Not Provide Medical Advice

Simple BP Tracker does not provide medical advice.

The App is not a physician, nurse, healthcare provider, emergency service, or substitute for professional medical judgment.

Simple BP Tracker does not diagnose medical conditions or recommend medical treatment.

The App records values entered by the user and performs basic mathematical calculations using those values.

3. Do Not Rely on the App for Medical Decisions

Do not rely upon Simple BP Tracker to determine whether you should:

• Seek or delay medical care;
• Take, stop, increase, decrease, or change medication;
• Change a treatment plan;
• Diagnose hypertension or another medical condition; or
• Disregard instructions from a qualified healthcare professional.

Questions concerning your blood pressure, symptoms, medications, diagnosis, or treatment should be directed to an appropriately qualified healthcare professional.

If you believe you may be experiencing a medical emergency, seek appropriate emergency medical assistance rather than relying on Simple BP Tracker.

4. User-Entered Information

Simple BP Tracker records information entered by the user.

Foundry and Grit does not independently verify whether:

• A blood pressure measurement was taken correctly;
• A blood pressure monitor is accurate;
• A systolic or diastolic value was entered correctly;
• A date or time was entered correctly;
• Patient identifying information is correct; or
• An exported report contains information appropriate for a particular medical purpose.

You are responsible for reviewing your entries and exported reports for accuracy.

5. Thirty-Day Data Retention

Simple BP Tracker is designed to retain individual blood pressure readings for only 30 days.

Readings older than the applicable retention period are automatically deleted when the App performs its retention cleanup.

Simple BP Tracker is not intended to serve as a permanent medical-record archive.

If you want to retain information for longer than the App’s retention period, you are responsible for exporting or otherwise preserving that information before it is deleted.

Once an expired reading has been permanently deleted by the App, it may not be recoverable.

6. Delete All Data

Simple BP Tracker includes a function allowing you to permanently delete locally stored App data.

If you confirm a permanent deletion, the affected information may not be recoverable.

You are responsible for exporting information you wish to preserve before using the Delete All Data function.

7. Exported Reports

Simple BP Tracker may generate a PDF containing information including:

• Patient name;
• Date of birth;
• Blood pressure readings;
• Dates and times;
• Systolic and diastolic values; and
• A mathematical 30-day average of retained readings.

You control whether and with whom that report is shared.

An exported report may contain sensitive personal and health-related information.

You should verify the intended recipient before sending or sharing a report.

Foundry and Grit is not responsible for the subsequent handling of information that you intentionally export or share with another person, healthcare provider, application, or service, except to the extent responsibility cannot lawfully be excluded.

8. Privacy

Use of Simple BP Tracker is also subject to the Simple BP Tracker Privacy Policy.

The Privacy Policy describes how the App handles locally stored information and should be reviewed together with these Terms.

9. Device Security

Simple BP Tracker uses available Apple security capabilities to help protect information stored by the App.

You remain responsible for maintaining reasonable security over your device, including your device passcode and physical access to the device.

No software or security system can guarantee absolute security.

10. No Cloud Synchronization

Simple BP Tracker is designed to maintain its health records locally on the device on which they were entered.

The App does not provide cross-device synchronization of those health records.

Installing Simple BP Tracker on another device does not mean readings from the first device will automatically appear on the second device.

11. No Guarantee of Availability or Data Preservation

Software and electronic devices can fail.

Data may be lost because of device loss, device damage, operating-system problems, software defects, user actions, automatic expiration, deletion, or circumstances outside Foundry and Grit’s reasonable control.

If particular records are important to you, export and preserve them before they expire.

12. Ownership

Simple BP Tracker, including its software, design, branding, graphics, and original content provided by Foundry and Grit, is owned by or licensed to Foundry and Grit and is protected by applicable intellectual-property laws.

These Terms grant permission to use the App. They do not transfer ownership of the App or Foundry and Grit intellectual property to you.

13. Permitted Use

Subject to these Terms and applicable Apple terms, Foundry and Grit grants you a limited, personal, non-exclusive, non-transferable, revocable license to use Simple BP Tracker for lawful purposes on supported Apple devices.

You may not:

• Reverse engineer the App except where applicable law expressly permits;
• Circumvent its security mechanisms;
• Use the App to violate applicable law;
• Misrepresent your relationship with Foundry and Grit; or
• Copy or commercially redistribute the App except as permitted by applicable law or written authorization.

14. Updates and Changes

Foundry and Grit may update Simple BP Tracker to:

• Correct defects;
• Improve compatibility;
• Improve security;
• Respond to changes in Apple platforms;
• Comply with legal requirements; or
• Improve the App.

We may modify or discontinue features or the App itself, subject to applicable law.

15. Third-Party Services

Certain functions initiated by you may involve Apple or third-party services.

For example, when you choose to share an exported PDF, Apple’s sharing interface may allow you to use Mail, Messages, AirDrop, Files, printing, or third-party applications.

Foundry and Grit does not control those independent services and is not responsible for their separate terms, privacy practices, availability, or security.

18. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless Foundry and Grit LLC from third-party claims, liabilities, damages, and reasonable expenses arising from your unlawful misuse of Simple BP Tracker or material violation of these Terms.

This provision does not require you to indemnify Foundry and Grit for conduct for which indemnification cannot lawfully be required.

19. Governing Law

These Terms are governed by the laws of the State of Alabama, without regard to its conflict-of-laws principles, except to the extent applicable federal law or another jurisdiction’s mandatory consumer-protection law controls.

20. Venue

To the extent permitted by applicable law, any judicial proceeding arising from these Terms or Simple BP Tracker shall be brought in a court of competent jurisdiction located in the State of Alabama.

Nothing in this section eliminates any venue or consumer right that applicable law does not permit a user to waive.

21. Apple

If Simple BP Tracker is distributed through Apple’s App Store, you acknowledge that these Terms are between you and Foundry and Grit, not Apple.

Apple is not responsible for providing or maintaining Simple BP Tracker except to the extent required by Apple’s applicable terms.

Your use of Simple BP Tracker must also comply with applicable Apple Media Services Terms and App Store requirements.

Any rights Apple has as a third-party beneficiary under applicable Apple requirements are preserved.

22. Changes to These Terms

We may revise these Terms from time to time.

The current Terms will be made available through Simple BP Tracker or the Foundry and Grit website.

The “Last Updated” date will identify the most recent revision.

Where applicable law requires additional notice or consent for a material change, we will provide it.

23. Severability

If a provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will remain effective to the extent permitted by law.

24. Entire Agreement

These Terms, together with the Simple BP Tracker Privacy Policy and any additional terms expressly presented in connection with the App, constitute the agreement between you and Foundry and Grit concerning your use of Simple BP Tracker.
